These terms are the agreement between you and Krampus, LLC (“we”, “us”) for use of the Holiday Spirit app. By creating an account you accept them. We have tried to keep them to the things that actually matter, and to say them once.
You must be 13 or older to create an account. If we learn an account belongs to someone younger, we will close it.
Keep your login details to yourself; you are responsible for activity under your account. Tell us at support@krampus.studio if you think someone else has access to it. You can delete your account at any time from within the app or at krampus.studio/delete-account.
You keep ownership of the photographs and descriptions you submit. By submitting them you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content within Holiday Spirit and in connection with operating and promoting the app.
This license continues after you delete your account for submissions retained in anonymized form, as described in our Privacy Policy. If you want your submissions removed as well as your account, tell us and we will remove them.
Submitted photographs are publicly accessible. Anyone holding the image link can view a submitted photograph without signing in. Do not submit anything you would not want seen publicly.
Holiday Spirit offers optional cosmetic items for your profile. All purchases are made through Google Play’s billing system, and Google’s terms apply to the transaction itself.
What you buy is a limited, personal, non-transferable license to use the item inside Holiday Spirit. You are not buying property. Specifically:
Refunds are governed by Google Play’s refund policy and are issued by Google, not by us. Email support@krampus.studio and we will help you with a request, but we cannot issue the refund ourselves.
You agree not to submit or do any of the following:
Every listing and photograph carries an in-app Report control, and you can block another user so their submissions no longer appear to you. We review reports and may remove content or suspend or terminate accounts that breach these terms. Child safety reports are handled as described in our Child Safety Standards.
Holiday displays are often at private homes. Respect them: view from the street, do not trespass, do not obstruct access, and follow any signage or instruction from the occupier.
If you own or occupy a listed property, you can claim the listing and take control of it, or have it delisted entirely. Both require verifying your connection to the address. We do that by email and by hand, and we may ask you a question or two that somebody at the address would be able to answer. We do not require identity documents. You never have to give a reason for wanting a listing gone. Once verified, your decision to delist takes precedence over the submission of the user who created the listing.
Claiming a property you have no connection to is a breach of these terms and may be unlawful. We may reverse a claim we believe to be false and terminate the account responsible.
Holiday Spirit is provided as it is. We do not guarantee that it will be uninterrupted, that listings are accurate, or that a display exists as described. Locations are submitted by users and we do not verify them.
To the fullest extent permitted by law, Krampus, LLC is not liable for indirect, incidental, or consequential damages arising from your use of Holiday Spirit. Nothing in these terms limits liability that cannot lawfully be limited.
You may stop using Holiday Spirit and delete your account at any time. We may suspend or terminate an account that breaches these terms, and we will tell you why unless doing so would compromise a safety investigation or breach the law.
We may update these terms. We will change the date above and, where a change is significant, tell you in the app before it takes effect. Continuing to use Holiday Spirit after that means you accept the updated terms.
These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of laws rules. Any dispute arising out of them, or out of your use of Holiday Spirit, must be brought exclusively in the state or federal courts of that jurisdiction, and you consent to their personal jurisdiction.
